Court Tips and Tidbits:

Mailing Address:

Shandaken Justice Court
PO Box 6
7209 NY State Route 28
Shandaken, NY 12480

The Shandaken Court office is located at the Shandaken Town Hall, and court is in session, at this location, usually every Tuesday at either 1:30 p.m. or 7:00 p.m. The court office is open for non-court related matters on Tuesday and Thursday only. Justice Court start times alternate every other week. Traffic tickets may be paid online or by phone.

Check-In: Even if you have discussed your case with a court officer, it is important that you check-in with the court clerk in the front of the courtroom. Failure to doing so may result in your case not being called.

Burden of Proof: Unlike traffic matters heard in the Traffic Violations Bureau of NYC and other parts of the State, tickets in Town and Village Courts must meet the standard of proof beyond a reasonable doubt. Many legal scholars have debated exactly what is meant by proof beyond a reasonable doubt. However, everyone agrees that it is the highest standard of proof in the US judicial system.

Additional Information

Failure to Paying a Fine: Failure to pay a fine could result in many adverse consequences. The most common penalty is suspended a driver’s privilege to drive. If a driving is stopped for driving with a suspended license, the police officer has the authority to place the driver under arrest and charge the drive with a crime.

Insurance Increases: A conviction to a violation with points does not convert into an automatic insurance increase. The algorithm that most insurance companies use to assess an insurance increase is proprietary in nature and not widely shared the public. There are many factors that can be taken into consideration including but not limited the driver’s age, type of vehicle driving, and accident history.

Points: A speeding violation in New York ranges from 3 to 11 points. The amount of points that a driver receives is based on how many mph over the speed limit they were driving. For more information, look at the following chart:
